Definitions

STU - SellTheUsed.com
Client(s) - a customer of STU that displays their items for sale on the internet via our web site service.
Visitor - someone that visits the STU site via the internet and uses the site to browse through items that have been posted by our Clients.

Clients

  1. SellTheUsed.com provides a service to their Clients consisting of a web based, browser controlled, utility for uploading pictures and descriptions in order to display equipment/goods that the Client wishes to have displayed via the internet.
  2. The primary use of the service provided by STU is to allow the Client to put a "link" on their web site that links to STU and will display a list of the Client''s items (that they have previously added to the STU database) when that link is clicked.
  3. Since the posting of items is done completely by the Client and without the involvement of STU, the Client assumes all responsibility for the genuineness and accuracy of all postings.
  4. As an adjunct service, the Client''s items are viewable by a general visitor to the STU site via database search features on the site. STU makes no claims to the benefit of this feature to the Client and makes no claims that it may enhance the value of the service to the Client.
  5. STU may, at its own discretion, select not to display a Client''s items in the general search features found on STU, though this will not effect the intended performance of the site as described in item 2 above.
  6. STU may advertise the site and represent the site as a web site where an assortment of equipment for sale can be found, but does not covenant with the Client to do so.
  7. STU may deny a request to establish a new category or type and may change the category or type of an item at its sole discretion.
  8. Items entered by the Clients must be accurate and genuine of Manufacturer, Model and all other included details. If STU is aware of an item that violates this policy, the Client will be notified by email and given 5 days to rectify the discrepancy or respond. If after 5 days from the notification the Client has not corrected the inaccuracy or shown, to STU''s satisfaction, that the item is accurate and genuine, then STU may, at its sole discretion, delete the item from the Client''s listings.
  9. STU makes no claim as to the fitness for any particular use of the services provided, other than that as described above in items #1 and #2 pertaining to the service provided and the primary use of that service.
  10. The Client agrees that STU''s sole responsibility to the Client is to provide the service as described above in items #1 and #2, that ,and that STU shall not incur any liability to the Client greater than the fees paid to STU by the Client.
  11. Also, specifically, SellTheUsed.com makes no claims as to any benefit the Client may receive by their products being displayed to general visitors of the SellTheUsed.com site.
  12. Clients understand that Visitors to the SellTheUsed.com site have not been screened or reviewed in any manner by SellTheUsed.com and that any sale to a Visitor to SellTheUsed.com is at the Client''s own risk.

Visitors

  1. Visitors to the SellTheUsed.com site are welcome to browse through the items that our various clients have posted for display on their own sites.
  2. Visitors to the SellTheUsed.com agree that SellTheUsed.com is not responsible for any of the content posted by clients of SellTheUsed.com and visitors specifically agree to hold SellTheUsed.com and its parent entities harmless for any consequence of the visitor''s use of SellTheUsed.com.
  3. Visitors are additionally notified that clients are not reviewed by SellTheUsed.com for business standing, credentials, or creditworthiness and the products they sell are not reviewed for authenticity, quality, value or any other aspect that may affect the value of the item.
  4. Visitors understand that Clients of the SellTheUsed.com site have not been screened or reviewed in any manner by SellTheUsed.com and that any purchase from a Client of SellTheUsed.com is at the Visitor''s own risk.

Account Payment, Billing & Termination

  1. The service provided by STU is a month-to-month service and, as such, the Client may discontinue the use of the service at any time and is only obligated for payment through the current month''s charges.
  2. The Client must notify STU of their intent to terminate the service by the 25th of the month, or they will be charged for the next month''s service.
  3. STU will charge the Client''s credit card for the month''s service on the first of the month in question, plus or minus 2 days. For example The August payment may be charged on July 30th , 31st, August 1st, 2nd or 3rd.
  4. If a Client''s charge card is declined, for any reason, the Client will be sent an email, to the Billing contact email address given by the client, upon registering. If the charge has not cleared by the 5th of the month the Client''s account will be deactivated.
  5. Reactivation of a deactivated account may, at the sole discretion of STU, incur a $20 reactivation fee.
  6. Deactivated accounts that have not been resolved by the end of the month in which payment has not been made will be deleted along with all data retained in the account.
  7. If STU terminates an account "mid-month" then STU will refund the client on a pro rata basis determined by the number of days used in the month of termination.
  8. Termination of an account by the client in mid month will not result in a refund of unused time for the month.
  9. STU may terminate a Client account if, at STU''s sole discretion, the Client''s items are inappropriate for the site.
